Terms of Service — Variochess

Please read these Terms of Service ("Terms") carefully before using the Variochess application ("App"). By creating an account or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Variochess ("we", "us"). You must be at least 13 years of age to use the App. By using the App you represent that you meet this age requirement.

2. Your Account

You are responsible for maintaining the confidentiality of your password.
You are responsible for all activity that occurs under your account.
You must provide accurate information during registration (valid email address, a username that does not impersonate others).
You may not create multiple accounts to circumvent bans or suspensions.
You may not share your account credentials with others.

3. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms.
Harass, abuse, threaten, or intimidate other players through in-game chat or any other feature of the App.
Use automated tools, bots, scripts, or cheats to gain an unfair advantage.
Attempt to reverse engineer, decompile, or interfere with the App's server infrastructure.
Exploit bugs or security vulnerabilities. If you discover one, please report it to us rather than exploiting it.
Impersonate Variochess staff, administrators, or other players.
Transmit spam, advertisements, or unsolicited messages through in-game chat.

4. Intellectual Property

The App, its original content, features, and functionality are owned by Variochess and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our explicit written consent.

The chess rules and standard piece symbols are in the public domain. The Variochess game variant, map system, terrain mechanics, and specific game design are proprietary.

5. User-Generated Content

You retain ownership of any content you create (e.g. chat messages). By submitting content through the App you grant us a non-exclusive, royalty-free licence to store and display that content solely for the purpose of operating the service. We reserve the right to remove content that violates these Terms.

6. Service Availability

We aim to keep the App available at all times but do not guarantee uninterrupted service. We may suspend or discontinue the App or specific features at any time, with or without notice, for maintenance, upgrades, or any other reason. We are not liable for any loss resulting from service interruption.

7. Account Suspension and Termination

We reserve the right to suspend or permanently ban any account that violates these Terms, at our sole discretion and without prior notice. You may delete your account at any time by contacting us. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Variochess shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising out of your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim (which may be zero for free accounts).

10. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via a notice in the App or by email at least 14 days before taking effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation; if unresolved, through binding arbitration or the courts of the jurisdiction in which we operate.
